LIABILITY WAIVER, ASSUMPTION OF RISK, AND RELEASE OF CLAIMS

READ CAREFULLY BEFORE PURCHASING OR USING A TICKET

BY PURCHASING A TICKET, CHECKING THE REQUIRED ACKNOWLEDGMENT BOX, OR ENTERING THE EVENT, YOU AGREE TO THIS WAIVER IN FULL. 

Scream Works Florida is produced by Dark Tree Productions, LLC and operates in partnership with Parrish Elks Lodge Number 2889. Attendance is voluntary. 

 

1. ASSUMPTION OF RISK

 

You understand and acknowledge that attendance at a haunted attraction involves inherent and known risks, including but not limited to uneven walking surfaces, temporary structures, low lighting, fog, loud or sudden audio, strobe or lighting effects, enclosed or narrow spaces, startle based scares, moving scenery or props, weather conditions, crowds, and reduced visibility. 

You further understand that participation may cause panic, fear, anxiety, dizziness, disorientation, elevated heart rate, shortness of breath, or physical reactions, and you voluntarily choose to participate despite these risks.

You knowingly and voluntarily assume all risks of injury, illness, emotional distress, property damage, or death, whether caused by inherent conditions, environmental factors, the actions of other guests, or your own actions. 

 

2. RELEASE OF LIABILITY

To the fullest extent permitted by Florida law, you release and forever discharge Dark Tree Productions, LLC, Parrish Elks Lodge Number 2889, and their respective owners, officers, directors, employees, volunteers, actors, contractors, agents, and affiliates from any and all claims, demands, damages, losses, or causes of action arising out of or related to your attendance or participation.

This release includes claims based on ordinary negligence, premises conditions, crowd flow, lighting, temporary structures, props, scenery, environmental effects, and operational decisions. 

This release does not apply to gross negligence or intentional misconduct, as defined under Florida law. 

 

3. MEDICAL AND PERSONAL RESPONSIBILITY ACKNOWLEDGMENT

By attending, you affirm that you are physically and mentally fit to participate. You acknowledge that the attraction is not recommended for individuals who are pregnant or who have heart conditions, respiratory conditions, epilepsy, seizure disorders, PTSD, panic disorders, or other medical conditions that could be aggravated by intense stimuli.

You accept full responsibility for monitoring your condition and agree to exit immediately if you feel unsafe or unwell. 

 

4. MINORS 

​

Guests under the age of 18 must be accompanied by a parent or legal guardian unless otherwise permitted by event policy. 

​

A parent or legal guardian purchasing a ticket for a minor acknowledges and accepts the risks of participation on behalf of the minor and agrees to indemnify and hold harmless the released parties from any claims arising from the minor’s attendance, to the fullest extent permitted by Florida law. 

 

5. INDEMNIFICATION 

​

You agree to indemnify, defend, and hold harmless Dark Tree Productions, LLC and Parrish Elks Lodge Number 2889 from any claims, damages, costs, or expenses, including reasonable attorneys’ fees, arising from your actions, your violation of posted rules, or your failure to comply with staff instructions. 

 

6. CONDITIONS OF ENTRY AND SAFETY COMPLIANCE

Conditions of entry include, but are not limited to, no bags, closed toe shoes required, no re entry once exiting, no intoxication, no weapons, and compliance with all posted signage and staff instructions. 

​

You acknowledge that safety policies are enforced in coordination with fire marshal guidance and local safety standards, and failure to comply may result in removal without refund. 

 

7. PHOTO AND VIDEO RELEASE 

​

You grant permission for your likeness, voice, or image captured during the event to be used for promotional, marketing, or archival purposes without compensation. 

 

8. ARBITRATION, VENUE, AND GOVERNING LAW 

​

Any dispute arising from your attendance shall be resolved through binding arbitration in the State of Florida. You waive the right to a jury trial. 

​

This agreement shall be governed by the laws of the State of Florida. Venue for any permitted court action shall lie exclusively in Manatee County, Florida. 

 

9. SEVERABILITY AND BINDING EFFECT 

​

If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect. 

​

This agreement is binding upon you and your heirs, executors, administrators, and legal representatives. 

 

BY PURCHASING OR USING A TICKET, YOU CONFIRM THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THIS LIABILITY WAIVER AND ASSUMPTION OF RISK IN ITS ENTIRETY.
